These Website Terms of Use (“Terms”) apply to your use of all websites, subdomains and associated online services operated or controlled by MCT Automotive Group Pty Ltd (ACN 636 285 017 / ABN 59 636 285 017) and its related bodies corporate, including MCT Wholesale Cars Pty Ltd (ACN 670 888 936 / ABN 16 670 888 936) and EZ Prestige Pty Ltd (ACN 653 962 335 / ABN 27 653 962 335) (together, “MCT Group”, “we”, “us” or “our”).

We may add new brands and services, or consolidate or retire existing websites, from time to time. These Terms apply to all websites operated or controlled by MCT Group (collectively, “our websites”), whether or not specifically listed above.
By accessing or using any of our websites, you agree to be bound by these Terms. If you do not agree, you must not use our websites.
These Terms should be read together with our Privacy Policy (located at: https://www.mctgroup.com.au/privacy-policy/). Specific transactions are governed by separate brand-level terms (see Chapter 2).
By accessing or using our websites, you accept these Terms in full.
We may amend these Terms from time to time by posting the updated version on our websites. The “Last updated” date at the end of these Terms will show when the Terms were last revised. Changes take effect from the date of posting. Your continued use of our websites after a change is posted will be deemed acceptance of the updated Terms.
If any part of these Terms is found by a court or tribunal to be invalid, illegal or unenforceable, that part will be severed from these Terms and the remainder will continue in full force.
In these Terms:
Content means all text, images, graphics, photographs, audio, video, software, data, page layout and source code on our websites.
Forms means any form on our websites through which you may submit information to us, including Reserve Now, Join Waiting List, Free Valuation, Sell My Car, Get a Quote, Book an Appointment, Contact Us and similar.
Transaction Terms means the specific terms and conditions that apply to a particular transaction (such as the purchase, sale, trade-in or servicing of a vehicle, or an application for credit) that we provide to you at the time of that transaction.
You means any person accessing or using any of our websites.
Our websites are provided as a general source of information about MCT Group and the products and services we offer. Information on our websites is provided in good faith based on information available to us at the time of publication.
Vehicle availability, specifications, pricing, kilometres, condition, colours, optional features and equipment may change after publication.
Finance figures shown on our websites (including interest rates, comparison rates and repayment estimates) are indicative only, are based on assumptions, and are not an offer of credit. Final terms are subject to credit assessment and approval.
Finance-related enquiries submitted through our websites may be handled by MCT Automotive Group Pty Ltd, including under the Loans4uS brand, as Authorised Credit Representative Number 536785 of Finance Ezy Pty Ltd (Australian Credit Licence Number 392182).
We do not warrant that any information on our websites is accurate, current, complete or fit for any particular purpose. You should always confirm relevant information with an authorised representative of the applicable MCT Group brand before relying on it.
Information on our websites is of a general nature only. It is not legal, financial, credit, valuation, or other professional advice, and is not intended to be relied on as such.

We do not endorse, control, or take responsibility for the content, products, services, or privacy practices of any third-party website or platform. Accessing third-party content is at your own risk and subject to that third party’s own terms and privacy policies.
Any information you transmit to us through our websites, including through forms, uploads, or enquiry features, is transmitted over the internet and may be subject to risks inherent in internet communications.
While we take reasonable steps to protect information submitted through our websites, we do not guarantee the security of information transmitted to or from our websites over the internet. You are responsible for maintaining your own security measures (including antivirus protection) and should run an appropriate virus check before downloading any file.
If you become aware of any security issue or vulnerability affecting our websites, you should notify us promptly using the contact details in section 22.
All Content on our websites is owned by, or licensed to, MCT Group and is protected by Australian and international copyright, trademark and other intellectual property laws.
You may view and print pages from our websites for your personal, non-commercial use, provided you do not alter any copyright, trademark or other proprietary notices.
You must not, without our prior written consent:
copy, reproduce, distribute, transmit, display, publish, sell or licence any Content;
use any Content to create a competing site, database, publication, dataset or training corpus;
mirror, frame or embed any portion of our websites on another site;
aggregate or republish vehicle inventory, pricing, photographs or descriptions from our websites; or
remove, obscure or modify any copyright, trademark or proprietary notice.
All trademarks displayed on our websites (whether owned by us or by third parties such as vehicle manufacturers) are the property of their respective owners. Unauthorised use of any trademark is strictly prohibited.
When using our websites, you must not:
use our websites for any unlawful purpose, or in a way that may damage, disable, overburden or impair them;
submit false, misleading or fraudulent information through any Form (including using another person’s identity);
attempt to gain unauthorised access to any part of our websites, our systems, any administrator interface, or another user’s account;
interfere with, circumvent or attempt to defeat any security, authentication, rate-limiting, bot-detection or content protection measure;
submit content that infringes another person’s intellectual property, privacy or other rights, or that is defamatory, offensive, obscene, threatening, harassing or unlawful;
impersonate any person or entity, or misrepresent your affiliation with any person or entity;
use our websites to harvest contact details for sending unsolicited communications (spam);
introduce any virus, malware, worm, trojan, time-bomb or other malicious code;
use any device or technique to interfere with the operation of our websites or with other users’ use of our websites;
encourage or assist any third party to do any of the above; or
use our websites in any way that breaches these Terms or any applicable law.
You must not, without our prior express written consent:
access our websites using any robot, spider, crawler, scraper, automated agent or other automated means;
harvest, extract, collect, copy, index or cache any Content or data from our websites in bulk;
use any automated method to collect vehicle inventory, pricing, photographs, descriptions or other Content from our websites for any purpose, including for:
aggregation, comparison or republication on another platform;
market intelligence, research databases or data brokerage;
use as input data for training, fine-tuning, evaluating, validating, benchmarking or grounding any machine learning model, large language model, generative artificial intelligence system or other artificial intelligence system;
mirror, frame or embed any portion of our websites on another site or application;
access any non-public API, endpoint, backend or administrative interface;
circumvent, disable, defeat or attempt to circumvent any rate limit, CAPTCHA, IP block, bot-detection system, access control or other technical measure used to restrict access to our websites;
access areas of our websites that are disallowed by our robots.txt file or other access-control instructions; or
ignore any instruction or response code (including HTTP 429 “Too Many Requests” and 403 “Forbidden”) issued by our websites.
The express prohibitions in this Section apply whether or not you intend any commercial use, and apply to access from any jurisdiction.
Reservation of rights for AI training: All Content on our websites is published with the express reservation of rights against text-and-data-mining and use as training data for any artificial intelligence system. This Section constitutes an explicit notice to that effect.
If you breach this Section, we may, without limiting our other rights and remedies, restrict or block your access to our websites and take any other action reasonably necessary to protect our systems, content, and business.
We may, without notice and without liability to you:
suspend, restrict or terminate your access to our websites;
remove or block any Content or submission; or
refuse to process any reservation, enquiry, or transaction,
if we reasonably believe you have breached these Terms or any applicable law, or where it is otherwise necessary to protect our websites, other users, or our business.
We do not guarantee that our websites will be available without interruption or error. We maintain editorial and operational control over our websites and may alter, amend, suspend, restrict, or discontinue any part of our websites, including any content, feature, service, or functionality, at any time and without notice. We may, without notice and without liability:
suspend or restrict access to our websites for scheduled or emergency maintenance;
modify, suspend or discontinue any feature, service or section of our websites;
restrict access during a security incident or suspected attack; or
restrict access due to events outside our reasonable control, including hardware failure, telecommunications failure, power outage, cyber-attack, natural disaster, pandemic, civil unrest, war, or government action (see Section 20).
To the maximum extent permitted by law, and subject to section 16.3, we are not liable for any loss arising from the unavailability of our websites or from changes to content, features, or services on our websites.
The functions available on our websites — including reservations, valuations, finance enquiries and service bookings — are intended to facilitate communication between you and MCT Group. Submitting information through our websites does not, of itself, create any binding contract or transaction. The specific terms of any subsequent transaction are governed by the applicable Transaction Terms provided to you at the time of that transaction.
Prices, finance figures, valuations, trade-in indications and other figures displayed on our websites are indicative only and may differ from the final figures offered to you. Final pricing is set out in the Transaction Terms provided at the time of the transaction.
Where you use our websites to obtain a valuation for, or to offer for sale, your vehicle to us — including through the Sell My Car, Free Valuation or trade-in features — any indicative valuation provided online is not a binding offer by us to purchase. Any subsequent inspection-based offer, and the terms on which we will purchase the vehicle, are governed by the applicable Transaction Terms.
Where you book a service or roadworthy inspection through the EZ Prestige website, the booking is subject to confirmation by EZ Prestige and to capacity and parts availability.
Finance-related enquiries submitted through our websites may be handled by MCT Automotive Group Pty Ltd, including under the Loans4uS brand, as Authorised Credit Representative Number 536785 of Finance Ezy Pty Ltd (Australian Credit Licence Number 392182).
Finance figures shown on our websites are indicative only. Final terms are subject to credit assessment and approval.
Where you proceed into a finance-related process, additional credit-related privacy documentation, disclosures, and consents may apply.
To the maximum extent permitted by law, our websites are provided on an “as is” and “as available” basis. We do not make warranties as to accuracy, completeness, availability, or fitness for any particular purpose.
Subject to section 16.3, we are not liable for loss arising from your use of, or inability to use, our websites, or from your reliance on information on our websites.
Subject to section 16.3, and to the maximum extent permitted by law, we are not liable for loss arising from unauthorised access to, or interference with, information submitted through our websites, or from cyber incidents affecting our websites or the systems of our service providers, except to the extent such liability cannot lawfully be excluded.
Nothing in these Terms excludes, restricts or modifies any right or remedy you may have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law to the extent that right or remedy cannot lawfully be excluded, restricted, or modified.
You are liable to us for loss we suffer to the extent it is caused by your breach of these Terms, your unlawful use of our websites, or your submission of false, misleading, or fraudulent information through our websites.
Nothing in this section makes you liable for loss to the extent it is caused by our acts, omissions, negligence, or breach of law.
Personal information submitted through our websites will be handled in accordance with our Privacy Policy.
Where you proceed into a finance-related process, additional credit-related privacy documentation and disclosures may also apply.
We may assign or transfer our rights and obligations under these Terms to a related body corporate, successor, or acquirer of our business, provided that doing so does not materially reduce your rights under these Terms.
We are not liable for any failure or delay in performing our obligations under these Terms to the extent caused by events beyond our reasonable control, including natural disasters, fires, floods, earthquakes, pandemics, war, civil unrest, labour disputes, sabotage, cyber-attack, government action, failure of telecommunications networks, or power outages.
These Terms and your use of our websites are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and the courts of appeal from them.
